Terms and Conditions of Online Customer Inquiry Service

    1. General Information of the Online Service
      This service is an Online Customer Inquiry Service (the "Online Service") which makes it possible for customer to verify information as well as execute transactions via the website of AEON Thana Sinsap (Thailand) Public Company Limited ("AEONTS") under the terms and conditions as prescribed hereinbelow and those to be further prescribed by AEONTS.
    2. Agreement on Using the Online Service
      2.1 In the course of using the Online Service, the customer agrees to be bound and liable to AEONTS under the terms and conditions herein prescribed including those to be further prescribed by AEONTS. AEONTS reserves the right to amend the terms and conditions as it deems appropriate.
      2.2 The customer agrees that the execution of transaction via the Online Customer Inquiry Service System (the “System”) using User Name and Password assigned to or determined by him/her in accordance with the conditions prescribed by AEONTS shall be deemed as a correct and valid transaction and be accorded as sound and trustworthy evidence which can be cited against him/her without necessity to require further evidence bearing his/her signature. Also, he/she agrees not to challenge or object to any such transaction or the accuracy thereof.
      2.3 The customer may order screen-printing the transaction page in order to retain as his/her own evidence of the transaction executed.
      2.4 AEONTS reserves the right to provide the Online Service during the service hours announced on its website for part or all of the Online Services. In this regard, AEONTS may consider to review, decrease or increase service types as it deems appropriate.
      2.5 The customer agrees and acknowledges that AEONTS may sometimes be unable to provide the Online Service in the event of breakdown, malfunction, improvement or reparation of the computer system, component, telecommunication system and/or relevant network system or any other force majeure events.
      2.6 AEONTS has the right to suspend or terminate the Online Service temporarily or permanently at any time without prior notice to the customer.
    3. Conditions of the Online Service Usage
      For the safety sake of the Online Service usage by the customer, the customer agrees:
      3.1 To ensure that the computer terminal, equipment and other electronic communication devices for using the Online Service have adequate capacity and have been installed with protection against computer viruses, worms and any other deceptive programs designed to destroy data stored in computer and firewall as well as possess specifications equivalent to or better than the standard specifications set by AEONTS.
      3.2 To be careful in filling out information regarding credit card or MCE card and his/her personal information while using the Online Service and executing transaction via the System.
      3.3 Not to disclose to other person his/her personal information including User Name and Password assigned to or determined by him/her.
      3.4 Not to leave the computer terminal, equipment and other electronic communication devices unattended while using the Online Service and to log off from the System every time after completion of the transaction.
      3.5 In the event that the customer makes internet connection to the System using a local area network or a public internet service network or by other means, the customer agrees to be responsible for any damages incurred by AEONTS and any other person should there be an unauthorised transgression into the System and executing transaction or access to personal information of the customer or other person being AEONTS’s customer.
      3.6 If the Password assigned to the customer by AEONTS is lost, stolen or if at any moment the customer is in doubt of the User Name and Password's confidentiality, the customer shall promptly have his/her Password changed as it is regarded as his/her direct responsibility to be performed without delay.
      3.7 In the event of error while using or transacting via the System, the customer shall inform AEONTS in writing within 7 days from the date of using or transacting, otherwise it shall be deemed that the execution of transaction via the System has been correct and completed.
      In notifying the error, the customer shall prepare and send to AEONTS a letter confirming the transaction which shall contain at least the following information:
        3.7.1 Date and time of the transaction;
        3.7.2 Location of the computer terminal, equipment and other electronic communication devices for using the Online Service;
        3.7.3 Number of credit card or MCE card, name and surname of the customer and contactable telephone number;
        3.7.4 Type of transaction; and
        3.7.5 Brief description of the error;
    4. Protection of Customer Security
      AEONTS reserves the right to suspend the Online Service for a temporary period if incorrect Password is entered repeatedly in excess of times allowed by AEONTS.
    5. Exemption of Liability
      AEONTS will not take any responsibility for any loss, damage or difficulty incurred by the customer from using or transacting via the System in the following cases:
      5.1 The customer discloses his/her User Name and/or Password to other person so as to allow such other person to login and execute transactions on his/her behalf, including to use the Online Service in a manner in violation of the law.
      5.2 Any negligence and carelessness on the part of the customer have occurred while using the Online Service.
      5.3 Any event of non-compliance or breach of the terms and conditions of the Online Service specified herein, other rules and regulations for using the Online Service imposed by AEONTS, or violation of relevant law and/or rules and regulations regulating the Online Service occurs.
      5.4 Any event of error as a result of alteration or cancellation of the instruction and/or data in the course of transmission to the System or defect of the System and/or component of the internet browsing program and/or the internet service provider of the customer or AEONTS occurs.
      5.5 Any event of intrusion and/or attack by any person or group of person on any hardware, software and/or components relating to the System, including (but not limited to) release of virus program script such as Trojan Horses and Worms, etc. that may suspend, disrupt or disable the Online Service occurs.
      5.6 Any destruction and/or error of the System, program and/or equipment for using the Online Service whether it be of AEONTS or other person, including (but not limited to) destruction and/or error of the system, program, computer server system, electricity supply system, telecommunication devices, electricity devices, telephone line and/or telecommunication network system and/or any part of electronic system occurs.
      5.7 Any loss of data in the course of transmission whether via the System, other system of AEONTS or such other system of the customer or internet service provider.
      5.8 Any damage incurred from fire, earthquake, flood, accidents, riots, civil disturbances, war, disruption of electricity or services provided by the network service provider, or force majeure beyond the control of AEONTS making it impossible to provide the Online Service to the customer.
    6. Online Service Fees
      AEONTS reserves the right to collect and/or revise Online Service fees as it deems appropriate (at present, the customer can use the Online Service free-of-charge).
    7. Communication
      AEONTS shall make contact with the customer at the postal or email address currently given to it or any subsequent change thereof that becomes in effect.
      The customer agrees to allow AEONTS to communicate with him/her by email and on AEONTS's website, including for the purpose of advertising and marketing products and services of AEONTS and other persons/entities.
    8. Other Conditions
      8.1 If any part of the terms and conditions contained herein is invalid, contrary to any law or unenforceable, the customer agrees that the invalidity, contradiction and unenforceability of such part shall not affect or prejudice the validity of the remaining terms and conditions which shall continue to be valid.
      8.2 The terms and conditions contained herein shall be regarded as the principal terms and conditions of the Online Service. If there is any agreement on “supplementary service” of any kind between AEONTS and the customer, the customer agrees that the terms and conditions of such supplementary service shall be regarded as supplementary or additional to the principal terms and conditions, and that in the event in which conflicts or inconsistency has arisen between the principal and the supplementary, this principal terms and conditions shall prevail.
      8.3 In case of the principal terms and conditions contained herein differ in any way to the terms and conditions for the use of other services provided by AEONTS, this principal terms and conditions shall be applied with the Online Service only.
      8.4 The customer and AEONTS agree that the terms and conditions contained herein shall be interpreted in accordance with and governed by the laws of Thailand and that settlement of any dispute, if arising, shall be carried out at the court of competent jurisdiction in Thailand.
