Terms and Conditions of AEON THAI MOBILE Application and AEON Online Service
1. General Description of the Service
AEON THAI MOBILE Application
and AEON Online Service
(collectively "Online Service") are services provided
by AEON Thana Sinsap (Thailand) Public Company Limited ("AEON") for users of the Online
Service ("Customer") to apply for product, execute transactions,
or verify account information via mobile application of AEON on mobile phone or
tablet (collectively "Application") or website of AEON ("Website").
2. Terms and
Conditions of Service Usage
In
using the Online Service, the Customer hereby acknowledges and agrees as
follows:
2.1
The Customer agrees to be bound by and comply with this terms and conditions
including any terms and conditions to be further prescribed or amended by AEON
as it deems appropriate, which shall form an integral part of this terms and
conditions. The methods of access and the types of Online Service available via
the Application and the Website may vary accordingly.
2.2
The Customer agrees that the use of the Online Service requires a Personal Identification
Number (PIN) created by the Customer. The use of the Online Service with the
PIN, including identity verification through a One-Time Password (OTP) or any
other electronic method specified by AEON, shall constitute a valid and
complete electronic act and signature by the Customer. It shall be legally
binding on the customer and can be used as evidence to confirm the Customer's
use of Online Service. In this regard, the Customer waives the right to dispute
or raise any objection against AEON regarding the use of Online Service under
any circumstances.
2.3
The Customer agrees and acknowledges that AEON may not be able to provide the
Online Service temporarily in the event of breakdown, malfunction, improvement
or reparation of the computer system, component, telecommunication system and relevant
network system or any force majeure events.
2.4 AEON reserves the
right to suspend or terminate the Online Service, in whole or in part,
temporarily or permanently at any time with notice to the Customer as deemed necessary
or appropriate.
3. Duties and
Responsibilities of the Customer
For security in using the
Online Service, the Customer agrees to and acknowledges the following duties
and responsibilities:
3.1
To ensure that the mobile phone, tablet, computer, any other electronic device,
connection to internet network and/or web browser (collectively the "Device")
used to access the Online Service is compatible with the Online Service and is protected
against computer viruses, malwares or any other programs that may compromise
data access or pose other threats. The Device must meet the standards
qualifications prescribed by AEON.
3.2
To exercise caution when accessing and entering the Customer’s information,
including but not limited to personal data, PIN, OTP, credit card account
information, loan account information, and any other Customer’s information throughout
the use of the Online Service.
3.3 To preserve the confidentiality
and refrain from disclosing to any third party the personal data, PIN, OTP,
credit card account information, loan account information, and any other
information of the Customer. AEON has no
policy to
inquire about
the PIN
or
OTP from the
Customer under any circumstances.
3.4
To safekeep and ensure security of the Device used for the Online Service. The
Customer agrees to be bound and liable in the event that the Device is modified,
altered, or otherwise tampered with in any manner that may pose a risk to the
security of data and the use of the Online Service, including the installation
of applications or scripts from unknown sources or sources not specified by AEON,
using the Online Service via unsecured devices, public devices or public
internet connections. In such cases, AEON reserves the right to immediately
suspend the provision of the Online Service, in whole or in part, and the Customer
shall be fully responsible for all the transactions executed and the damages
incurred by themselves, AEON, or any third party.
3.5
In the event that the Customer's Device, personal data, PIN, OTP, credit card
account information, loan account information, or any other information of the
Customer is lost, stolen, disclosed, or used by unauthorized person, or if the Customer
suspects that such an event may occur, the Customer shall immediately notify AEON
and comply with the conditions and methods as prescribed by AEON.
3.6
In the event of an error occurring during the use of or while conducting
transactions via the Online Service, the Customer shall inform AEON in writing
within 7 days from the date of such error.
Failure to do so shall be deemed as acceptance
that the transaction was accurate and valid.
In reporting the error,
the Customer shall prepare and submit a written document containing at least
the following information to AEON:
3.6.1
Date and time of the transaction;
3.6.2 Location of the computer terminal, equipment or electronic
devices used to access the Online Service and type of internet network used;
3.6.3
Credit
card or loan account
number
(if any), first name, last name and contactable
telephone number of the
Customer;
3.6.4
Type of transaction; and
3.6.5
Details of the error and reference code (if any)
4. Security Measures
AEON reserves the
right to suspend the Online Service if the Customer has exceeded the number of
permitted wrong password attempts. Such suspension shall result in the
immediate cancellation of any transactions that are in progress under the Customer’s
instructions via the Online Service. In this regard, the Customer shall not be
entitled to claim any compensation for damages arising from such suspension. To
resume the Online Service, the Customer can contact AEON Contact Center at
02-665-0123 during AEON’s working days and hours.
5. Disclaimer of Warranties
All information and
materials displayed on the Application and Website, including text, graphics,
links or other items are provided on "as is" and "as
available" basis. AEON makes no representations or warranties regarding
the accuracy, adequacy, or completeness of such information and materials, and
shall not be held liable for any errors or omissions therein. AEON expressly
disclaims all warranties of any kind, whether express, implied, or statutory,
including but not limited to warranties of non-infringement of third-party
rights or ownership, fitness for a particular purpose, suitability for use, and
freedom from computer viruses.
6. Limitation of
Liability
AEON
shall not be liable for any malfunction, loss, or damage, whether direct or
indirect, incurred by the Customer in connection with the use of the Online Service
under any circumstances, including but not limited to the following cases:
6.1
The Customer discloses or provides personal data, any other information, or the
Device to any third party for accessing the Online Service.
6.2
The Customer uses the Online Service in violation of the law or in a manner
that does not comply with AEON’s terms and conditions.
6.3
The malfunction, loss, or damage results from the Customer’s intentional act or
negligence.
6.4
The Customer fails to comply with or violates the terms and conditions of the Online
Service or any other applicable requirements, whether existing or to be announced
in the future.
6.5
The malfunction, loss, or damage results from changes, modifications, or
cancellations of instructions and/or data submitted to the Online Service
system, or from operational failures, errors, omissions, interruptions,
defects, delays in processing or transmitting data of the system and/or web
browser and/or internet service providers.
6.6
In case of data breach and/or destruction of hardware, software and/or
equipment related to the Online Service system by individuals, groups of
individuals, or programs or commands that pose threats to the system, such as
viruses, Trojan horses, or worms, which may affect the operation of the Online Service
system.
6.7
In case of damage and/or inoperability of systems, programs, and/or any
equipment used for the Online Service, whether belonging to AEON and/or third
parties, including but not limited to damage and/or errors of systems,
programs, computer servers, power supply systems, communication devices,
electrical equipment, telephone lines, and/or communication networks and/or any
part of electronic systems.
6.8
Loss of data during transmission, whether related to the Online Service system
or other systems of AEON, the Customer, or internet service providers.
6.9
The malfunction, loss, or damage results from fire, earthquake, flood,
accident, riot, protest, political unrest, war, lockout or strike, power system
failure, or internet service provider issues, including other force majeure
events beyond AEON’s control that render the Online Service unusable.
In
any case under Clauses 6.1 – 6.4, the Customer agrees to be responsible for all
the damages incurred by AEON and any other parties in full.
7. Service Fees
The
Customer agrees to pay any service fees, charges, and expenses related to the
use of the Online Services at the rates specified by AEON. (Currently, the Customer
can use the Online Service free of charge).
8. Personal Data
8.1
The Customer agrees that AEON shall have the right to collect, use, disclose,
and process data, including but not limited to the Customer’s personal
information, service usage history, communications, transaction logs, and
recorded telephone conversations for the purposes of providing the Online Service,
verifying and authenticating the Customer’s identity (KYC), reviewing and
processing applications and requests, conducting checks, and for any other
purposes necessary or appropriate for the provision of the Online Service.
8.2
The Customer acknowledges and agrees that AEON may disclose the Customer’s
personal information, such as name-surname, telephone number, and national
identification number, to telecommunications service providers (TSPs) for
identity verification and maintenance of security of the Online Service such as
preventing unauthorized transactions or unlawful activities including identity
theft or impersonation. Such disclosure to TSPs shall be limited to what is
necessary for identity verification purpose only.
8.3 The Customer can

9. Communication
AEON may contact the Customer
via the Application, postal mail, email, SMS, or telephone using the address,
email, or phone number last given or informed by the Customer to AEON.
10. Termination of Service
10.1
AEON reserves the right to terminate the Online Service without prior notice to
the Customer under the following circumstances:
(1) The Customer has not logged in to use the Online Service
for more than 1 year from the date of successful Online Service registration or
the last login date.
(2) The Customer breaches any terms and conditions of the Online
Service including failure to pay service fee, charges or any expenses, or
outstanding balance related to the Online Service or other AEON’s product or services
for any reason.
(3) Any information provided by the Customer, including
personal data, is untrue, false, inaccurate, or the Customer’s use of the Online
Service poses a risk to the Online Service system or is for made with fraudulent,
dishonest, or illegal purposes in any respect.
(4) The Customer commits identity theft, impersonates
another person, falsifies another person’s information, or uses another
person’s information to register for the Online Service, regardless of whether
the person whose information was used is aware, consents, or colludes.
(5)
All AEON’s products and services used by the Customer are cancelled or the Customer
is deceased or has been declared legally incompetent or quasi-incompetent..
10.2 AEON has the
right to terminate any and all types of the Online Service without prior notice
to the Customer.
10.3 The Customer may
cancel the Online Service according to the method specified by AEON. Once the
cancellation takes effect, any pending transactions initiated by the Customer
through the Online Service will be immediately canceled.
11. Other Conditions
11.1
If any part of this terms and conditions is invalid, unlawful, or
unenforceable, such invalidity shall not affect or impair the remaining
provisions, which shall remain valid and enforceable under the law.
11.2
In the event that there is an agreement between the Customer and AEON regarding
any supplemental services for the use of the Online Service, the Customer
agrees and acknowledges that such supplemental services shall be considered
part of the Online Service. This terms and conditions shall also govern the supplemental
services. In the event that this terms and condition is contradictory to the
terms and conditions governing the supplemental services, the terms and
conditions of the supplementary services shall apply specifically to those
supplemental services.
11.3
The Customer may print documents confirming their transactions for
record-keeping purposes.
11.4
If the terms and conditions of the Online Service differ from those of other
AEON services, the terms and conditions of the Online Service shall apply
exclusively to the Online Service.
11.5
Any delay, omission, or waiver by AEON in exercising its rights or seeking
remedies under the law or this terms and conditions shall not affect or
constitute a waiver of such rights or remedies. A delay, omission, or waiver on
any occasion or in part shall not prevent AEON from exercising its rights or
seeking remedies on other occasions, in other parts, or for other rights or
remedies. It shall not be deemed that AEON has waived its rights or consented
to any action by the Customer.
11.6 The Customer and
AEON agree that Thai law shall govern this terms and conditions and that they
shall be interpreted in accordance with Thai law. The Thai courts shall have
jurisdiction over any disputes arising in connection with the Online Service
and the supplemental services under the Online Service.
Terms and Conditions of
PAYNOW
Service
1.
PAYNOW
service is a
supplementary service of the Online Service which enables the Customer to
make payments according
to
AEON
billing statements
and other types of
payment AEON may serve in the future.
PAYNOW
service is accessible via the Application
only.
2.
Payment through
PAYNOW
service is made by debiting
the Customer’s bank account opened with the prescribed commercial banks (the “Bank”)
through payment channel of the Bank such as mobile banking, online direct debit
or such other payment channel to be determined by AEON. The Customer who wishes
to use
PAYNOW
service must have a bank
account with the Bank and must have applied for mobile banking or direct debit
service for such account. Maximum payment limit per time and per day and service
fees shall be as announced and charged by the Bank.
3.
The Customer hereby agrees and acknowledges that confirmation of any payment
instruction on
PAYNOW
service in the manner
prescribed by AEON shall be regarded as the Customer’s expression of intention
to debit his/her bank account. Upon receipt of the Customer’s payment
instruction, AEON shall send the payment instruction to the Bank and the Customer
shall afterwards confirm the payment instruction with the Bank in the manner so
prescribed for the transaction to be completed.
In
case the remaining balance in the bank account is less than the amount of
payment the Customer wishes to make, the Bank shall have the sole right to
decide whether to proceed for partial payment or not proceed the payment at
all. In such case, the Customer must inquire to the Bank directly.
4. AEON shall not be
responsible for any loss or damage suffered by the Customer or other person
from using
PAYNOW
service which are caused
by errors or mistakes from payment instruction of the Customer or the Customer’s
device, communication or internet network, the Bank, external service provider
or other person, insufficient account balance and other causes beyond control
of AEON.
5. Unless stated
otherwise, terms and conditions of Online Service shall apply to
PAYNOW
service to the extent
not contradictory to the terms and conditions of
PAYNOW
service.
Terms and Conditions of
Payment Allocation Service
1.
Payment Allocation service is a supplementary service of the Online Service
which enables the Customer to allocate his/her unidentified or incorrectly
identified payment made to AEON. Payment Allocation service is accessible via the
Application only.
2.
Once AEON has found unidentified payment, AEON will send an alert to the Customer
via the Application so that the Customer can allocate such payment through
Payment Allocation Service.
3.
Customer hereby agrees and acknowledges that allocation of payment by the Customer
via Payment Allocation service shall be regarded as the Customer’s expressing intention
to make payment according to the allocation, he/she has made. In the event that
the Customer does not allocate the payment or allocates incorrectly or only
partially by the time specified by AEON, AEON shall allocate payment for the Customer
in accordance with AEON’s criteria.
4.
AEON may suspend Payment Allocation service temporarily during the account
closing period of AEON in each month or after AEON has already allocated the Customer’s
payment or in other events AEON deems appropriate.
5.
AEON reserves the right to suspend the Payment Allocation service in case the Customer
has not used the Online Service via the Application for 4 consecutive months or
more, or in other cases AEON deems appropriate.
6. Unless stated
otherwise, terms and conditions of Online Service shall apply to Payment
Allocation service to the extent not contradictory to the terms and conditions
of Payment Allocation service.
Terms and Conditions of Cardless Cashing Service
1. AEON credit cardholders and/or loan account holders may execute the Cardless Cashing transaction according
to the methods, procedures and within the period of time specified by AEON via the Application, and receive
cashing amount at the ATM of the bank or other service provider designated by AEON.
2. The Customer can do cashing not exceeding daily cashing limit and the maximum number of permitted
transactions per day as determined by AEON.
3. The Customer hereby agrees that the Customer’s execution of Cardless Cashing transaction and receipt of
cashing amount from AEON shall be considered as a valid and correct cashing transaction which has the same legal
effect as the use of credit card and/or member card together with PIN as assigned by AEON or subsequently set by
the Customer to execute cashing transaction.
4. The Customer can cancel the Cardless Cashing transaction by the methods and procedures determined by AEON.
In addition, should the Customer not withdraw the cashing amount within the prescribed period, that particular
cashing transaction will be automatically canceled.
5. The Customer hereby agrees to pay service fees, charges and other expenses incurred from using the Cardless
Cashing Service including cash withdrawal fee charged by bank or other service provider.
6. Unless stated otherwise, terms and conditions of the Online Service shall apply to Cardless Cashing Service
to the extent not contradictory to the terms and conditions of Cardless Cashing Service.
The Customer has read and understood the terms and conditions of AEON THAI MOBILE Application, AEON Online
Service and terms and conditions of the relevant supplemental services. By clicking "Agree", "Accept", or by using the Online Service, it shall be deemed that the Customer agrees to and accepts the terms and
conditions of AEON THAI MOBILE Application, AEON Online Service and terms and conditions of the relevant
supplemental services.
